Refund Policy

This Refund Policy (“Policy”) governs the refund terms for purchases made in connection with Balance Technology INC. (Company ID: 20258395917, incorporated on December 25, 2025, with registered address at 1312 17th Street Unit 2588, Denver, CO, 80202 US, hereinafter “Balance”, “We”, “Us”) games and services (the “Service”). This Policy complies with the laws and regulations of the State of Colorado, including but not limited to the Colorado Consumer Protection Act (CCPA) and Colorado Revised Statutes Title 6, Article 1-10 et seq.

By making a purchase through the Service, you agree to the terms of this Refund Policy. If you do not agree to these terms, you should refrain from making any purchases through the Service.

  1. Eligibility for Refunds
    • Refund requests are subject to the following eligibility criteria, in compliance with Colorado law:
      • Digital Content & Virtual Currency: Virtual currency (“Bux”) and in-game digital content (including but not limited to skins, expansions, add-ons) are non-refundable unless:
        • The content was not delivered to your account within 48 hours of a confirmed purchase;
        • The content is defective, non-functional, or does not match the description provided at the time of purchase; or
        • You are a Colorado resident and submit a refund request within 3 days of purchase (consistent with Colorado’s consumer cooling-off period for digital goods, where applicable).
      • Minors’ Purchases: If a purchase is made by a minor (under 18 years of age) without the explicit consent of a parent or legal guardian, the parent/guardian may submit a refund request within 60 days of the purchase date. Balance may require proof of age and relationship to the minor to process such refunds.
      • Unauthorized Purchases: Refunds may be granted for unauthorized purchases if you provide sufficient evidence (e.g., transaction records, account activity logs) that the purchase was made without your knowledge or consent. Such requests must be submitted within 60 days of the transaction date. Balance reserves the right to investigate unauthorized purchase claims and may take steps to secure your account.
    • Refund requests that do not meet the above eligibility criteria will be denied at Balance’s sole discretion, unless required by Colorado law.
  2. Non-Eligible Refund Scenarios
    • The following purchases are not eligible for refunds, except as required by Colorado law:
      • Purchases of virtual currency or digital content that have already been used, redeemed, or consumed (e.g., spent Bux, used in-game items);
      • Purchases made more than 3 days prior (for Colorado residents) or 7 days prior (for non-Colorado residents) for non-defective digital content;
      • Purchases made through unauthorized third-party platforms (refunds for such purchases must be requested directly from the third party);
      • Refund requests submitted without valid proof of purchase (e.g., transaction ID, receipt, or email confirmation);
      • Purchases voluntarily cancelled after delivery of the digital content (unless the content is defective).
  3. Refund Request Process
    • To submit a refund request, you must:
      • Contact our support team via email at [email protected] with the subject line “Refund Request - [Your Transaction ID]”;
      • Provide the following information in your request:
        • Full name and account username associated with the purchase;
        • Transaction ID (from your payment provider or Balance account history);
        • Date and time of purchase;
        • Description of the item/service purchased;
        • Reason for the refund request (including evidence of eligibility, e.g., proof of defect, minor status, unauthorized purchase);
        • For Colorado residents: Confirmation of residency (e.g., billing address in Colorado).
      • Submit the request within the timeframes specified in Section 1 of this Policy.
    • Balance will review your refund request within 10 business days of receipt (in compliance with Colorado’s requirement for timely response to consumer claims). We will notify you via email of our decision to approve or deny the request.
    • If approved, refunds will be processed within 5 business days of the approval notice. Refunds will be issued to the original payment method used for the purchase, unless the original method is no longer available (in which case we will coordinate with you to arrange an alternative refund method).
  4. Refund Limitations & Deductions
    • Where applicable, Balance may deduct the following amounts from approved refunds (consistent with Colorado law):
      • Any fees charged by payment processors (e.g., credit card fees, Apple/Google Play store fees) that are non-recoverable by Balance;
      • The value of any in-game benefits or content already consumed/used by you (e.g., Bux spent, items redeemed) prior to the refund request;
      • Administrative fees (not to exceed $10 or 5% of the purchase amount, whichever is lower) for processing refunds, where permitted by Colorado law.
    • Refunds for defective content will not include any deductions for administrative fees, in compliance with Colorado’s consumer protection laws.
  5. Right to Modify Refund Policy
    • Balance reserves the right to modify this Refund Policy at any time, in compliance with Colorado law. Changes to this Policy will be posted on the Service and will take effect 14 days after posting, unless required by law to take effect sooner.
    • Continued use of the Service and making purchases after changes to this Policy constitute your acceptance of the revised terms.
  6. Dispute Resolution
    • If you disagree with our refund decision, you may:
      • Submit an appeal to [email protected] within 10 days of receiving the denial notice, providing additional evidence to support your claim; or
      • File a complaint with the Colorado Attorney General’s Office (Consumer Protection Division) or pursue remedies under Colorado law, including small claims court for disputes under $7,500 (the Colorado small claims limit).
    • Balance will not discriminate against any consumer who exercises their rights under Colorado law to dispute a refund decision.

  • Severability
    • If any provision of this Policy is found to be unlawful, void, or unenforceable under Colorado law, that provision will be deemed severable from the remaining provisions, which will remain in full force and effect. The unenforceable provision will be replaced with a valid provision that most closely reflects the original intent of the parties, consistent with Colorado law.
  • Governing Law
    • This Policy is governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any legal action arising out of or related to this Policy must be brought in the courts of Denver County, Colorado, in compliance with Colorado Revised Statutes.
